Orbiva Terms & Conditions

1. Acceptance

By installing or using Orbiva ("the app"), you agree to these Terms. If you do not agree, please uninstall the app. You must be 18 or older. The app is provided by oodhwe ("we", "our", "us").

2. Not Medical Advice

Orbiva is a habit-tracking tool. It does not give medical, nutritional or clinical advice, and it does not diagnose, treat or prevent any condition. Any descriptions shown in the app are general, estimated information and may not apply to you.

Fasting is not suitable for everyone, including people who are pregnant or breastfeeding, have diabetes or other medical conditions, take medication, are under 18, or have a history of disordered eating. Talk to a qualified healthcare professional before fasting. Stop fasting and seek medical help if you feel unwell. You use the app at your own risk.

3. What the App Does

• Times your fasts and shows elapsed time, with optional reminders when your goal time passes.
• Logs water with quick-add buttons and a daily target.
• Shows your history, streaks and totals, worked out from your own records.
• Saves a backup file and exports a CSV of your records, to a place you choose.

4. Licence and Use

We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, subject to these Terms and Google Play's terms. You may not copy, modify, resell or redistribute the app, reverse-engineer it except as permitted by law, or get around the limits of the free plan.

5. Free Plan and Orbiva Pro

The app has a free plan and an optional paid subscription, Orbiva Pro. Which features belong to each plan may change over time. Your stored records are never deleted when features change or your subscription ends, and backup and restore stay free.

6. Subscriptions

• Plans and prices: monthly and annual plans are shown in the app and on Google Play before you buy, in your local currency where available.
• Free trial: new subscribers may get a free trial. If you do not cancel before it ends, the subscription becomes paid and your Google Play payment method is charged.
• Renewal: payment is charged to your Google Play account. The subscription renews automatically for the same period unless you cancel before the current period ends, in the time Google Play requires.
• Cancelling: manage or cancel at any time in Google Play under Payments & subscriptions → Subscriptions. You keep access until the end of the period you paid for.
• Refunds: purchases are made through Google Play, so refunds follow Google Play's refund policy and applicable consumer law. We cannot refund Google Play purchases directly.
• Price changes: we will give notice as Google Play and the law require, and you can cancel before a change applies.

7. Your Data

Your records are stored on your phone. You are responsible for backing them up. We are not responsible for data lost through uninstalling, a lost or broken phone, or a lost export file. See the Orbiva Privacy Policy.

8. Reminders

Android battery and power-saving settings can delay or block notifications. Do not rely on the app for time-critical or medical decisions.

9. Intellectual Property

The app, its name, design, text and artwork belong to oodhwe or its licensors. Your own records remain yours. Other product names and trademarks belong to their respective owners.

10. Disclaimer and Liability

The app is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We are not liable for indirect or consequential loss, loss of data, or health outcomes arising from your use of the app. Our total liability is limited to the amount you paid for the subscription in the 12 months before the claim. Nothing here limits rights that cannot be limited under the law of your country, including consumer-protection rights.

11. Changes and Ending Use

We may update or discontinue the app, or update these Terms; the "Last updated" date shows when. You may stop using the app at any time. We may suspend access if you breach these Terms.

12. Privacy

Our handling of information is described in the Orbiva Privacy Policy, which forms part of these Terms.

13. Governing Law

These Terms are governed by the laws of India. Courts at the seat of oodhwe have jurisdiction. Mandatory consumer rights in your country of residence are not affected.
